PETITION: Justice for victims of rape and sexual violence in Burma
[This petition was sent to the Association of Southeast Asian Nations (ASEAN) on 23 September 2008. For those who added their names, thank you for being a voice for the voiceless victims of sexual violence in Burma. ]
We would like to seek justice on behalf of a 15-year-old girl from Kachin State, Burma and others like her who have been raped and sexually violated by the Burma army.
We are saddened to know about Nhkum Hkawn Din, 15, who was gang-raped, severely mutilated and murdered by Burma Army soldiers on 27 July. She was attacked near Nam Sai village, Bhamo District, Kachin State on her way to bring rice to her brother who was working in a paddy field. She was reported missing and three days later her naked body was found 200 meters from an army checkpoint. Witnesses have testified to seeing Burma Army soldiers follow Nhkum Hkawn Din on her way to the paddy field, and leaving the area after she disappeared.Her family and local villagers claim to know which soldiers carried out the attack, but local authorities have refused to take action. According to her family, Nhkum Hkawn Din sustained multiple stab wounds on her stomach, right rib cage and other parts of her body. Her skull had been crushed and facial features “obliterated”.
Various women’s organizations among Burma’s ethnic groups have documented thousands of cases of rape and sexual violence committed by the Burma army as a weapon of war. Sadly, we have not heard of any instance when the perpetrators were brought to justice.
This July, Burma ratified the ASEAN Charter, and its foreign minister, Mr. Nyan Win, was reported as saying that their participation in the Charter demonstrates their “strong commitment to embrace the common values and aspiration of the people of Asean to build .. a sharing and caring community.”
We believe the ASEAN has a critical role to play in our region, especially in the area of human rights. The ASEAN should hold Burma accountable based on its own act of ratifying the ASEAN Charter which vows to uphold and protect human rights. Through Resolution 1820 passed on 19 June 2008, the UN Security Council has recognized that rape can constitute war crimes and crimes against humanity, and has demanded that all acts of sexual violence in conflict zones be halted.
On behalf of all women and girls in Burma who have been victimized by the Burma army, we respectfully urge the ASEAN to demand Burma’s State Peace and Development Council:
1) to immediately bring to a halt the use of rape and sexual volence as a weapon of war in its conflict zones;
2) to investigate, identify and prosecute members of the Burma Army who are found responsible for participating in these acts;
3) to compensate victims and their families;
4) to take appropriate measures to protect women and girls from sexual violence; and
5) to impose appropriate military disciplinary measures and uphold the principles of command responsibility.
